1. Definitions

In these Terms & Conditions, the following definitions apply:

  • "We," "Us," "Our," "Marinova" refers to Marinova, a wellness yacht experience provider operating in Phuket, Thailand.
  • "You," "Your," "Guest" refers to any individual who books or participates in our wellness experiences.
  • "Services" refers to all wellness yacht experiences we provide, including Wellness Morning Float, Restorative Sea Day, and Healing Waters Retreat.
  • "Website" refers to our online presence at marinov.live.
  • "Agreement" refers to these Terms & Conditions together with any booking confirmation.

2. Acceptance of Terms

By accessing our website, making inquiries, booking our services, or participating in our wellness experiences, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not use our services.

These terms constitute a legally binding agreement between you and Marinova. We reserve the right to modify these terms at any time, with changes becoming effective upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.

3. Eligibility and Capacity

To book and participate in our wellness experiences, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts under Thai law
  • Provide accurate and complete information when making bookings
  • Be physically capable of participating in gentle wellness activities including swimming, yoga, and meditation

If you are booking on behalf of other participants, you confirm that you have authority to accept these terms on their behalf and that they meet all eligibility requirements.

4. Service Description

Marinova provides wellness-focused yacht experiences in the waters around Phuket, Thailand. Our services include:

  • Wellness Morning Float: Half-day restorative experience aboard a catamaran with wellness guidance and light refreshments
  • Restorative Sea Day: Full-day wellness charter with practitioner sessions, wellness meals, and peaceful locations
  • Healing Waters Retreat: Multi-night wellness voyage with accommodations, daily sessions, and comprehensive wellness support

All services include certified wellness practitioners, appropriate yacht vessels, crew, and the specific features described in our service descriptions. We reserve the right to make reasonable modifications to services based on weather conditions, safety requirements, or other operational necessities, while maintaining the core wellness experience promised.

5. Booking and Reservations

5.1 Booking Process

Bookings are made through direct contact with Marinova via phone, email, or our website contact form. A booking is confirmed only when you receive written confirmation from us, typically within 24 hours of your request.

5.2 Booking Requirements

To complete a booking, you must provide accurate information including full names of all participants, contact details, any relevant wellness considerations or dietary requirements, and emergency contact information.

5.3 Availability

All bookings are subject to availability. We maintain small group sizes to ensure personalized wellness attention, which may limit availability during peak seasons. We recommend booking at least two weeks in advance for single-day experiences and three to four weeks for multi-night retreats.

6. Payment Terms

6.1 Pricing

All prices are stated in Thai Baht (THB) and include applicable taxes. Current pricing is:

  • Wellness Morning Float: ฿32,000 THB
  • Restorative Sea Day: ฿95,000 THB
  • Healing Waters Retreat: ฿198,000 THB (base rate for two-night retreat)

Prices are subject to change but confirmed bookings honor the price quoted at the time of booking.

6.2 Payment Schedule

  • A deposit of 50% is required within 48 hours of booking confirmation to secure your reservation
  • The remaining balance is due seven days before the experience date
  • For bookings made within seven days of the experience date, full payment is required immediately upon booking

6.3 Payment Methods

We accept bank transfers and major credit cards through our secure payment processor. Payment details will be provided in your booking confirmation.

6.4 Currency

All transactions are processed in Thai Baht. If paying from a foreign account, your financial institution may apply currency conversion fees.

7. Cancellation and Refund Policy

7.1 Guest Cancellation

If you need to cancel your booking, the following terms apply:

  • More than 14 days before experience: Full refund minus 10% administrative fee
  • 7-14 days before experience: 50% refund of total payment
  • Less than 7 days before experience: No refund, though we may offer credit toward a future booking at our discretion

7.2 Marinova Cancellation

We reserve the right to cancel experiences due to weather conditions, safety concerns, or operational requirements. In such cases, you will receive a full refund or the option to reschedule to an alternative date.

7.3 Refund Processing

Refunds are processed within 14 business days of cancellation notice and returned using the original payment method.

8. Guest Responsibilities

As a participant in our wellness experiences, you agree to:

  • Arrive at the designated meeting point on time, understanding that late arrival may result in shortened experience time without refund
  • Disclose any health conditions, physical limitations, or concerns that might affect your participation or safety
  • Follow reasonable instructions from crew members and wellness practitioners regarding safety and vessel protocols
  • Respect other guests' need for peaceful restoration and maintain appropriate conduct throughout the experience
  • Refrain from excessive alcohol consumption or illegal substance use before or during the experience
  • Take responsibility for your personal belongings, as Marinova is not liable for lost or damaged items
  • Inform us immediately if you feel unwell or uncomfortable during any wellness activity

9. Health and Safety

9.1 Health Disclaimer

Our wellness experiences involve gentle physical activities including yoga, swimming, and meditation. While these activities are designed to support restoration and are suitable for most fitness levels, they are not medical treatments. If you have any health concerns, we strongly recommend consulting your healthcare provider before participating.

9.2 Swimming and Water Activities

Guests should be comfortable in water and able to swim unassisted. Life jackets are available for all guests. Participation in water activities is voluntary, and guests may choose their level of engagement.

9.3 Maritime Safety

All vessels meet Thai maritime safety standards and carry appropriate emergency equipment. Crew members are trained in emergency procedures and first aid. In the unlikely event of an emergency, follow crew instructions immediately.

9.4 Weather Conditions

We monitor weather conditions closely and may modify itineraries or reschedule experiences if conditions affect safety or the quality of the wellness experience. Such modifications are at our discretion and do not constitute grounds for refund.

10. Limitation of Liability

To the fullest extent permitted by Thai law:

  • Marinova's total liability for any claim arising from your participation in our services shall not exceed the amount you paid for the specific experience
  • We are not liable for any indirect, incidental, special, or consequential damages
  • We are not responsible for personal injury or property damage resulting from your failure to follow safety instructions or disclosure of health conditions
  • We are not liable for acts of nature, severe weather, or other circumstances beyond our reasonable control

This limitation does not affect liability that cannot be excluded or limited under Thai law, including liability for death or personal injury caused by our negligence.

11. Indemnification

You agree to indemnify and hold harmless Marinova, its owners, employees, and contractors from any claims, damages, or expenses arising from your violation of these terms, your use of our services, or your violation of any rights of another party.

12. Intellectual Property

All content on our website and in our marketing materials, including text, graphics, logos, and photographs, is the property of Marinova and protected by Thai and international copyright laws. You may not reproduce, distribute, or create derivative works from our content without written permission.

During wellness experiences, we may take photographs for marketing purposes. If you prefer not to be photographed, please inform us at the start of your experience.

13. Privacy and Confidentiality

We are committed to protecting your privacy and maintaining confidentiality regarding your wellness journey with us. Personal information and health-related details you share are handled according to our Privacy Policy.

Wellness practitioners maintain professional confidentiality regarding session content and any personal information you choose to share during wellness activities.

14. Termination of Services

We reserve the right to terminate services and require a guest to leave a wellness experience if:

  • The guest's behavior poses a safety risk to themselves or others
  • The guest is under the influence of illegal substances
  • The guest significantly disrupts the peaceful environment needed for other guests' restoration
  • The guest refuses to follow reasonable safety instructions from crew or practitioners

In such cases, no refund will be provided.

15. Force Majeure

We are not liable for failure to perform our obligations if such failure results from circumstances beyond our reasonable control, including natural disasters, severe weather, acts of government, labor disputes, or other force majeure events. In such cases, we will work with you to reschedule or provide appropriate alternatives.

16. Dispute Resolution

If you have concerns about our services, please contact us first at [email protected]. We are committed to resolving issues amicably and will make reasonable efforts to address your concerns.

Any disputes that cannot be resolved informally shall be governed by Thai law and subject to the exclusive jurisdiction of the courts in Phuket, Thailand.

17. Severability

If any provision of these Terms & Conditions is found to be unenforceable or invalid under Thai law, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms & Conditions, together with our Privacy Policy and any booking confirmation, constitute the entire agreement between you and Marinova regarding our services and supersede any prior agreements or understandings.
